Mae’s agree to apologise to Indigenous student

first_imgAfter days of public outrage over the treatment of a pupil, who was shamed after he turned up to school in Indigenous attire for Culture Day, Mae’s administration has agreed to apologise to the nine-year-old boy.This was during a meeting held on Monday afternoon at the Amerindian Peoples Association (APA) Head Office, which saw APA Executive Director Jean La Rose; GIS Specialist & Forest Policy Officer Michael Mc Garrell; Communications & Visibility Officer Nicholas Peters; Mae’s Schools Director Stacey French and Administrator Lucinda Mc Curdy; and the boy’s parents, Jason Chacon and Karen Small, as well as other stakeholders sitting down to discuss the incident.Karen Small recounts the incident during a meeting with representatives from the APA and Mae’s SchoolsAccording to a statement from the APA, French agreed to apologise to the boy and his parents, but made no commitments on a public apology.“After some back and forth on the matter, and with the APA stressing on what culture really means to Indigenous peoples in Guyana, the school’s director agreed that she would apologise to the young man on the turn the incident took and the trauma that he experienced shortly after,” the missive from the APA detailed.However, the Association pointed out that a public apology was necessary, since not only the boy and his family but the Indigenous people were hurt by this incident, which has been denounced across the country.Monday’s meeting, which was organised by the APA, was the first time the boy’s parents had come face to face with the school’s administration since the incident and Small, the mother of the child, was able to recount directly to the school’s top administration how the incident took place and to express her concerns about its impact on the nine-year-old. She also took the opportunity to highlight some inaccuracies contained in a statement released by the school on the incident.Meanwhile, the school‘s representative also said that she too was not happy about inaccurate media reporting that the child was not allowed to enter the school. However, the APA pointed out that the issue was bigger than whether the child was allowed entry or not, it was a matter much larger that deemed a people’s culture as “inappropriate” which in turn resulted in the child feeling that he should dislike his culture after being made to feel uncomfortable in his ethnic dress.Moreover, the organisation posited that the incident should be used both as a teaching and learning opportunity for the students and faculty of the school. To this end, the APA offered to help the school in sensitising students and others on larger issues affecting Indigenous peoples and their role in society.The school has agreed to host a session in collaboration with the Association to inform students and faculty of Indigenous culture and overcoming the negative stereotypes which continue to exist.Nevertheless, the APA sees the outcome of the meeting as a step in the right direction towards not only resolving this particular incident, but also addressing cultural prejudices that may persist today.Apart from this meeting, the school’s officials also met with representatives from the Ministries of Education, Social Cohesion, and Indigenous Peoples’ Affairs on Monday.last_img read more

West Brom star ready to quit just months after £8m move

first_imgJames Chester is weighing up his West Brom future less than four months after moving to the Hawthorns.The 26-year-old has started just one Premier League match for the Baggies since arriving in a £8m deal from Hull City.The Welshman says his lack of game time is harming his international career ahead of Euro 2016, and has suggested he could be looking for a way out of West Brom in January.“To be playing for Wales I have to start playing for my club because it’s impossible to play at this level and not be playing week in, week out,” Chester said, after starting for his country in their 3-2 defeat to Holland on Friday.“I know myself I need to be playing at my club to give me the best chance of going to France and playing when we get there.“I don’t think it’s good enough to be playing for Wales when I’m not playing for West Brom.“It’s nearly impossible to not play every week and then expect to be 100 per cent to stop players of (Arjen) Robben and (Wesley) Sneijder’s class – and that’s the level we will play in France in every game.“(Wales manager) Chris Coleman has been brilliant to me and that’s nice to hear, so it’s up to me to go back to West Brom and play. But I’m finding it difficult.”Former Manchester United trainee Chester was promoted into the Premier League with Hull and had two seasons in the top-flight before joining West Brom last summer in the wake of the Tigers’ relegation.He was part of a three-man central defence at Hull and also with Wales, playing a key role as Coleman’s side qualified for the European Championship next summer, but his rare Albion appearances under Tony Pulis have come at right-back.“When I signed (Pulis) said he knew I could play at centre-back but he wanted to use me at full-back,” Chester said.“I don’t really have a problem with that as long as I’m playing in the Premier League, which is where I want to be.“I think the disappointing part for me is I played the first game of the season and I think I showed enough, with hard work and playing there regularly, that is something I could become quite good at.“But to only give me one opportunity there I find it quite difficult to understand.”Chester, the most expensive defender in Albion’s history, revealed he spoke to Pulis in October to enquire what he had to do to get back in the first team at the Hawthorns.“He said he understood it was a new club and a new position and we had some work to do,” Chester said.“But up to the part of speaking to him I hadn’t done much work regarding playing right-back.“I asked him how I would get back if not doing the things he said to me.“I’m trying to stay professional and keep myself right for when I get the chance, because when I get there I feel I’m good enough to stay in the team.”Asked if he would look elsewhere in the January transfer window, Chester replied: “I’m 12 games into a four-year contract, but I’m not one who likes to sit and watch.“I want to play and I thought I was coming to West Brom to play in the Premier League.“Hindsight’s a wonderful thing and you see how Hull are doing at the start of the season, and I had other options which makes the situation a little more difficult.” 1last_img read more

GlaxoSmithKline Coughs Up 20 Million In SEC FCPA Enforcement Action Based On

first_imgIn this 2016 preview post, I noted that the end of September was likely to be an active period for FCPA enforcement.Why? Because the SEC’s fiscal year ends on September 30th that’s why.In the third SEC FCPA enforcement action of the week, the SEC announced this enforcement action in which GlaxoSmithKline plc (a U.K. company with shares traded on the NYSE) will cough up $20 million to resolve an administrative cease and desist order based on employees and agents of its China-based subsidiary and China-based joint venture providing various things of value to healthcare professionals in China.In summary fashion, the Order states:“These proceedings arise out of GSK’s violations of the internal controls and recordkeeping provisions of the FCPA.Between at least 2010 and June 2013, employees and agents of GSK’s China-based subsidiary and a China-based joint-venture engaged in various transactions and schemes to provide things of value to foreign officials, including healthcare professionals (“HCPs”), in order to improperly influence them and increase sales of GSK products in China.This misconduct was facilitated in part by the use of collusive third parties that ostensibly provided legitimate travel and other services. The funds used for the improper inducements were frequently obtained under the guise of, and falsely recorded in GSK’s books and records as, legitimate travel and entertainment expense, marketing expense, speaker payments, medical associations payments, and promotion expense. Throughout this period GSK failed to devise and maintain a sufficient system of internal accounting controls and lacked an effective anticorruption compliance program.The deficiencies in GSK’s internal accounting controls and compliance program also led to instances of similar improper conduct in connection with sales in other countries in which GSK operates.”The conduct at issue focused on GlaxoSmithKline (China) Investment Co. Ltd. (GSKCI), a wholly-owned indirect subsidiary of GSK, based in Shanghai and Sino-American Tianjin Smith Kline & French Laboratories Ltd. (TSKF) a joint venture with Tianjin Zhong Xin Pharmaceutical Group Corp. Ltd and Tianjin Pharmaceutical Group Co. Ltd. in which GSK owns 55%.The Order states:“From at least 2010 to June 2013, employees and agents of GSKCI and TSKF engaged in transactions and schemes to corruptly transfer things of value to foreign officials in China to increase sales of pharmaceutical products. The payments were made to increase sales through increased prescriptions by individual HCPs [healthcare professionals] and purchases by hospital administrative staff responsible for product selection or purchase. The conduct occurred across all geographic areas within the sales and marketing functions and impacted all product lines.The corrupt payments took varied forms, including gifts, improper travel and entertainment with no or little educational purpose, shopping excursions, family and home visits, and cash. The costs associated with these payments were recorded in GSK’s books and records as legitimate expenses, such as medical association sponsorships, employee expenses, conferences, speaker fees, and marketing costs.These improper practices were pervasive among GSKCI’s and TSKF’s sales and marketing representatives and were condoned by regional and district managers. For example, a 2013 work plan submitted by a sales representative to a regional sales manager described the intent to pay, among other things, an HCP RMB 20/box of prescribed product every month, and deliver appropriate gifts on each holiday in exchange for a guarantee of more than 40 boxes of prescribed product every month.Among the ways employees were able to fund payments to HCPs was the use of collusive third party vendors, such as those used to perform planning and travel services for events involving HCPs. Between 2010 and June 2013, GSKCI spent nearly RMB 1.4 billion (USD $225 million) on planning and travel services. Test sampling showed that approximately 44 percent of the sampled invoices were inflated and approximately 12 percent were for events that did not occur.Controls weaknesses also permitted ostensibly legitimate speaker fees to be used to improperly influence HCPs. While GSK’s policies as of 2010 placed limits on the amount of fees paid to speakers per hour and by 2012 cumulatively per year, there was no effective system in place to ensure the actual identity of a speaker. Of approximately RMB 106 million (USD $17 million) spent by GSKI in speaker fees, approximately RMB 14 million (USD $2.2 million) was paid to persons whose qualification as an HCP could not be verified.Marketing programs were another mechanism used to improperly influence HCPs. For example, in 2010, GSKCI engaged a local vendor to facilitate a national marketing program called the Cold Chain Project. The project was intended to provide healthcare clinics with tools to facilitate the storage and administration of vaccines that required refrigeration. However, the project was instead used to provide HCPs with gifts such as laptops, tablets, and other electronic devices. Over the life of the project, GSKCI paid out RMB 14.6 million (approximately USD $2.3 million). The project was created and administered by senior marketing and sales managers of GSKCI. The clinics selected were based upon the potential to market additional pharmaceutical products.During this period, local internal audit and compliance reviews identified controls deficiencies and evidence of some mechanisms that were used to fund the improper payments, but they were treated as isolated instances rather than signs of a larger problem. For example, in 2013 a Sales Rep Office Audit was conducted by internal audit with respect to the Guangzhou office. Among the problems identified were:Issues of falsified POS slips and fake bank statementsIssues of fake invoices claimed from hotels and restaurants for sales meeting activities. These invoices came from a local preferred meeting agency used by the Guangzhou office.Compliance and New Employee training not timely completedSales employees’ salaries were significantly driven by commissions that could lead to an incentive to improperly inflate sales. The audit sampled 20 percent of the sales team for the office and found that for 41 percent their sales commission bonuses were greater than 50 percent of their income.As early as 2010, internal audit identified problems related to sales and promotions staff practices in China. Among other findings it noted:[d]uring 2010, several new policies governing commercial activities such as grants and donations and sponsorships were introduced. The significant changes, combined with the high staff turnover, contribute to an environment where many commercial and medical staff do not understand how to apply policies or the rationale behind them. This was evidenced by approval of non-compliant activities, a lack of clarity on which policy to apply for activities such as grants, and weaknesses in documentation to support the legitimate intent of activities such as advisory boards and sponsorships of HCPs to attend meetings.” Based on the above findings, the SEC found that GSK violated the FCPA books and records and internal controls provisions.Without admitting or denying the SEC’s findings, GSK agreed to pay a $20 million civil penalty. In addition, GSK agreed to report to the SEC “periodically, at no less than nine-month intervals during a two-year term, [regarding] the status of its remediation and implementation of compliance measures.”Under the heading “GSK’s Remedial Efforts,” the Order states:“In determining to accept the Offer, the Commission considered remedial acts promptly undertaken by Respondent and cooperation afforded the Commission staff.1. During the course of the investigation, Respondent provided prompt and regular briefings regarding its own internal investigation in China, and with respect to other countries. Respondent timely conveyed the facts it learned in the course of its own investigation, promptly responded to document requests by the Commission staff, and provided translations of documents as needed.2. Respondent also provided detailed and timely information regarding its remedial efforts, enhancements to its compliance program and implementation of key initiatives.3. Respondent made global changes to its business. This included the elimination of most payments to doctors, including fees to HCPs to speak about the Company’s prescription medicines, and altering the compensation structure for its sales force to eliminate incentive pay based on the number of prescriptions generated. Respondent enhanced its global risk assessment process, strengthened its monitoring and risk assessment tools, and increased its global compliance organization. Respondent also enhanced its third-party oversight program, including increasing the number and scope of third-party audits, and increased training and education of employees on anti-bribery issues.”last_img read more
